I think this is a good work done by the team.  During Phase I, I had actively worked to make sure that using the European Convention as a baseline for legal considerations be removed from the text.  The reason was that it did not take into consideration the issues of other regions.  At least, not Africa.
 
I trust you understand the process involved in getting Conventions and Treaties signed at the global (UN) level.  If the principle of subsidiarity  is "an appropriate starting point for discussion", we should be ready for discussions that may last 15 years. Many countries will call the National Security and Defence issue into question.  Others will bring in issues like sovreignty, economic development, trade and commerce, cultural heritage etc ...
 
This means most of the issues will actually end up as national and regional.
 
To this end, I will suggest that :

   Issues that have to do with Fundamental Human Rights be upheld and maintained.
   Convention must respect the existing principles above
   Must also respect different developmental differences (that may not necessarily be national or regional)
   The subsidiarity principle then, comes in after basic HR and development issues .
