Intervention de la société civile sur la question des droits de l’homme
PrepCom1, seconde phase du SMSI, séance plénière, Hammamet  26 juin 2004

Je suis Souhayr Belhassen, vice-president de la La Fédération 
internationale des ligues des droits de l’Homme et vice presidente de la 
Ligue tunisienne des droits de l’homme.

En ce début de la seconde phase du SMSI, les organisations de la société 
civile présentes a  Hammamet souhaitent exprimer leurs objectifs et leurs 
priorités de travail en vue du Sommet de Tunis en 2005.

A l’heure où les fondations du droit international des droits de l’homme 
sont ébranlées par les lois et mesures adoptées, partout dans le monde, au 
nom d’une lutte contre le terrorisme, il était important que la Déclaration 
de principe adoptée a Geneve en 2003 se réfere aux principes essentiels 
d’universalité et d’indivisibilité de tous les droits de l’homme, au droit 
au développement, et réaffirme en particulier le nécessaire respect de 
l’intégralité de l’article 19 de la DUDH sur la liberté d’expression, 
d’information et de communication.

Cette seconde phase doit aller plus loin. Nous entendons en effet qu’elle 
précise ces principes en affirmant également le principe non-dérogeable de 
non discrimination, la nécessité du respect des standards internationaux 
relatifs aux droits des travailleurs, et la reconnaissance qu’une vraie 
sécurité ne peut être atteinte que grâce a des mesures entièrement 
compatibles avec les droits de l’homme internationalement reconnus, 
particulièrement le droit a la vie privée. En outre, nous ne pouvons 
accepter que la Déclaration de principes admette que l’état de droit soit 
supposé «refléter la situation réelle des pays », plutôt qu’être en 
cohérence avec les obligations légales des États découlant des traités 
internationaux relatifs aux droits de l’homme qu’ils ont ratifiés.

La phase de Tunis va concentrer ses travaux sur les questions de 
gouvernance d’Internet et de financement de l’infrastructure. Nous y 
prendrons toute notre part en veillant a ce que leurs résultats, loin d’y 
déroger, promeuvent la mise en oeuvre effective de l’ensemble des droits de 
l’homme.

Sans mise en oeuvre effective, les principes resteront en effet lettre 
morte. Nous entendons que le SMSI permette que ces principes se traduisent 
par une société de l’information et de la communication au service des 
droits de l’homme. A cette fin, nous souhaitons que le Sommet définisse des 
indicateurs précis permettant d’apprécier la réalisation de cet objectif et 
mette en place un mécanisme international et indépendant pour leur 
évaluation sur le terrain, au niveau local, régional et international.

Enfin, nous sommes pleinement conscients de l'importance fondamentale de la 
tenue du SMSI ici et pour les peuples de l'ensemble des pays du Sud, et 
nous souhaitons donc sa réussite. Toutefois, nous souhaitons réaffirmer 
qu’il incombe aux deux pays hôtes du Sommet de se montrer exemplaires, 
notamment dans la réalisation de la liberté d’expression, d’information et 
de communication, ainsi que de la liberté d’association et du droit a la 
vie privée.

Civil Society statement on human rights
PrepCom1, WSIS second phase, Hammamet  June 26 2004

I am Souhayr Belhassen, Vice-President of the International Federation for 
Human Rights and Vice-President of the Tunisian League for Human Rights.

At the beginning of this WSIS second phase, civil society organizations 
present in Hammamet wish to express their objectives and their working 
priorities in view of the Tunis Summit in 2005.

At a time where the foundations of international human rights law are being 
challenged by newly adopted laws and measures, everywhere in the world, in 
the name of a fight against terrorism, it was important that the 
Declaration of principles adopted in Geneva in 2003 makes reference to the 
fundamental principles of universality and indivisibility of all human 
rights, to the right to development, and specially reaffirms the necessary 
respect of the integrality of Article 19 of the UDHR on freedom of 
expression, of information and of communication.

This second phase must go beyond that. Indeed, we intend that it clarifies 
these principles by also reaffirming the fundamental principle of non 
discrimination, the necessity to respect international labor standards, and 
the recognition that a true security can only be reached with measures 
entirely compatible with internationally recognized human rights, not least 
the right to privacy. In addition, we cannot accept that the Declaration of 
principles admits that the rule of law is supposed to «reflect national 
realities» rather than being in coherence with the legally binding 
obligations of States according to the international human rights treaties 
they have ratified.

The Tunis phase will focus on Internet governance and infrastructure 
financing issues. We will take part in this work, making sure that its 
results ensure the promotion of the effective implementation of the whole 
set of human rights, and do not derogate from them.

Without effective implementation, the principles would indeed stay without 
substance. We request that WSIS allow for these principles to be translated 
into an information and communication society serving human rights. To this 
end, we wish that the Summit define precise indicators allowing to evaluate 
the realization of this objective and set up an international mechanism for 
their assessment on this ground, at the local, regional and international 
level.

Finally, we are entirely conscious of the fundamental importance of holding 
WSIS here and for the people of all the global South countries, and we thus 
wish its success. However, we wish to reaffirm that it is the duty of the 
two host countries of the Summit to show exemplarity, especially in the 
realization of freedom of expression, of information, of communication, as 
well as of freedom of association and the right to privacy.
